TERMS AND CONDITIONS FOR ONLINE PURCHASES

“We”, “Us” and “Seller” mean DREAM MAKERS GROUP OF COMPANIES Online Website.

“You’, “Customer (s)” and “Buyer” mean the person placing an order.

“The contract is agreed” – by completing and submitting an electronic order form, you are making an offer to purchase our products, which, if accepted by us, will only result in a binding contract. A follow up of an acceptance email from us confirms that the contract is formed.

By using the website to buy products online, you confirm that you are at least 18 years old.

1.ORDERING

By completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Please note that products will not be sent (or links to online products) until we have authorization from your payment card issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorized.

Once that information has been verified, you will be redirected to a download page which will allow you to download the purchased content. 4. CANCELLING AN ORDER PRIOR TO GOODS DISPATCHING

If you have changed your mind after an order, you can cancel it at any time before we sent it. Please see the contact Page for our telephone number. You will need to give us your name and address details, as well as your order number to cancel your order.

5. RETURNING GOODS AFTER DISPATCHING

Each product sold through DREAM MAKERS ENTERPRISE Online Website is guaranteed. If you are not satisfied with the product after receiving it, contact us for return of the payment price, as indicated in the guarantee.

6. PRICING AND PAYMENT

Prices throughout the website are quoted in Brunei Currency, and payment can only be accepted in Brunei Currency. Packing and delivery costs, if any, will be added to the total price of your purchase.

While we make every effort to ensure that the products shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case. If products you have ordered are unavailable, you will be notified as soon as possible.

The price you pay is the price of the products shown at the time you place your order, even if the price of the product has since changed.

Your payment card will be debited for your order at the time the order is placed. By submitting an online order with DREAM MAKERS ENTERPRISE Online Website, you expressly agree not to request a ‘charge back’ of any fees or payments for said orders, and that no dispute with DREAM MAKERS ENTERPRISE Online Website will be raised. Rather, you agree to contact DREAM MAKERS ENTERPRISE Online Website directly to resolve the issue or obtain a refund pursuant to the product guarantee.

Where an offer mentions that an item is reduced in price example half-price, the discount will be calculated before any postage or packaging chargers are applied.

If we discover an error in the price of the goods you have ordered, we will inform you as soon as reasonably possible. For products that require shipping, we will email you as soon as your order has been shipped and will advise of the shipping method (if any) at that time.

8. CHANGES OF TERMS & CONDITIONS TO GOODS PURCHASED ONLINE

We reserve the right to change these Terms & Conditions for buying products online from time to time. If this happens, we will notify you by posting the new Terms & Conditions for buying products online on the website. If you do not wish to be governed by the revised Terms & Conditions for buying products online, you must not place any further orders.

9. INFORMATION ABOUT GOODS PURCHASED VIA DREAM MAKERS ONLINE WEBSITE

By using the website (even if you don’t buy any goods) you also agree to be bound by these Terms & Conditions.

We try to make sure that all information on the DREAM MAKERS ENTERPRISE Online Website, including descriptions of our goods and listed prices, are accurate and correct at all times.

However, mistakes do happen. We will try to resolve all errors in information on our Online website as soon as reasonably possible and if we think that such an error has affected your order, we will try to let you know.

You should bear in mind that buying goods online or shopping online provides a different shopping experience from buying in-store. For that reason, you should be aware of the following;

All goods are subject to availability. We reserve the right to withdraw any goods from sale at any time, and our only liability to you for withdrawing any goods will be to refund to you any money paid to us in respect of those goods which we are no longer able to supply;

We will do our best to deliver your goods in accordance with the delivery date set out in our final delivery advice email, but please note that all delivery dates given by DREAM MAKERS ENTERPRISE Online (whether on the website, over the phone or by email) are estimates only and delivery dates may vary.

Not all goods and promotions that are offered by DREAM MAKERS Shop Online will be available in-store, and vice versa.

In principle, our online prices are the same as in our online catalogue and in our stores. Nevertheless, we reserve the right to adjust prices, goods and special offers at our discretion.

We will do our best to check the website for viruses, but we do not warrant that the website is free of viruses or other malicious content.

For your own benefit, you should make sure that you have appropriate software and systems in place to check for viruses and other malicious content on the internet.

11. GOOD AVAILABILITY

We have the right at any time to modify or stop providing or selling any or all goods through DREAM MAKERS ENTERPRISE Online Website, either temporarily or permanently and with or without notice. We shall not be liable to you for any modification, suspension or discontinuance of availability of the goods shown in DREAM MAKERS ENTERPRISE Online Website.

12. SECURITY OF INFORMATION DETAILS

All goods sold through DREAM MAKERS ENTERPRISE Online Website are intended for domestic use only; goods are not suitable for commercial or industrial use unless expressly stated.

14. PLACING AN ORDER

Please see How to…Shop Online for information about the steps involved in placing an order. Your order constitutes an offer to purchase goods from us. Where you order more than one item your order comprises a series of offers for each item individually.

Our order acknowledgement webpage and email set out the final details of your order which you have submitted to DREAM MAKERS ENTERPRISE Online Website. Please take care when placing your order, as you will be unable to add to or amend your order after we have sent the Order Acknowledgement email.

The order acknowledgement contains details of the goods you have ordered, the total cost of the order including delivery, and an order number. You should print off a copy of the Order Acknowledgement email, and a copy of these general terms & conditions and the returns policy and keep them safe. You will need to refer to these details when contacting us about your order.

Please note that the acknowledgement is simply an acknowledgement that your order has been received by DREAM MAKERS ENTERPRISE Online Website; it does not constitute an automatic binding contract

15. ORDER ACCEPTANCE

Acceptance of your order will take place only when we have dispatched the goods to you. Until we have dispatched your goods, no contract will have been formed between you and us.

Although we hope to be able to supply all goods ordered, we reserve the right, at our discretion and without the need to give reasons, not to accept any offer at any time prior to the formation of a binding contract. Should we refuse your order we will notify you as soon as reasonably possible.

16. GOODS RETURN POLICY

The terms and conditions set out in this policy apply to all goods purchased from DREAM MAKERS ENTERPRISE Online Website in Brunei Darussalam, whether you buy through our website or over the phone. The policy complies with the Consumer Protection (Fair Trading) Order 2011 and Contract Act CAP 106.

17. CANCELLING AN ORDER & OBLIGATION TO RETURN THE GOODS

Where you place an order through DREAM MAKERS ENTERPRISE Online Website you can cancel your order at any time before the goods are dispatched to you. We will provide a full refund of the price of the goods and any delivery and other charges which you have incurred.

Having paid the price of the goods after the formation of a binding contract, you can cancel your order up until 14 days after the day on which you have received the goods. You are required to notify us about the intended order cancellation and to return the goods immediately to us safely and in good re-saleable condition before we could make a refund.

No refund will be made to you if the goods which you have returned to us were found to have been tampered, altered, modified or did something on them while in your possession that have adversely affected their usefulness, value and functionality.

Nothing within this returns policy or the terms of sale affects your statutory rights under law, and in particular you will always be entitled to return goods to us for a full refund if they were misdescribed or are not of satisfactory quality or not reasonably fit for their purpose. However, in terms of goods quality satisfaction, we would only remedy the fault based on the satisfaction of a reasonable purchaser rather than specific individual.

18. METHODS OF CANCELLING AN ORDER

If you wish to cancel an order or contract, you just need to let us know that you have decided to cancel. You can do this by phone or in writing.

Call us on +673 2423575 or +673 8999900 Please have your order acknowledgement email to hand and be ready to quote your order number and to specify which goods you want to return.

You can alternatively complete the cancellation form; in which case we will email you to confirm that we have received your cancellation.

Whether you send your cancellation notice by post, phone or online, the cancellation will take effect on the day it is sent to us.

19. METHODS OF RETURNING THE GOODS

If the goods have been delivered to you before you decide to cancel your contract, you must return the goods to us without delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the contract.

If you would like to return the goods yourself, you can take them to our shop premises at DREAM MAKERS ENTERPRISE at Mata-Mata, Bandar Seri Begawan. You will need to take all the goods which you wish to return, together with a copy of your ORDER Acknowledgment email, delivery receipt and the payment card with which you have paid for the goods.

You agree to return the goods in full, in a re-saleable condition and we may also ask you to return the packaging with the goods whereby possible. You are responsible for the cost of returning the goods, unless the goods are faulty or not as described, in which case we will refund any reasonable costs you incur in returning the item to us. If you are returning your goods because they are faulty or incorrect, no collection fee will be charged.

20. REASONABLE CARE OF GOODS BY CUSTOMER(S)

You agree to take reasonable care of the goods from the time that they have been delivered to you until the time that they were returned. Once the goods have been safely delivered to the customer, the customer becomes responsible for loss or damage to the same.

21. CONDITIONS OF DELIVERY

Goods delivery to you place will be subjected to the following conditions:

You agree to provide DREAM MAKERS ENTERPRISE Online website with as much details as possible of relevant features of the delivery address which floor the goods are to be delivered to and whether or not there are any narrow doors etc. in order to help our representative prepare for such delivery;

You agree to ensure that there is suitable access to the chosen delivery location;

If our representative reasonably considers that delivery to your room of your choice is likely to cause damage to the goods or to your property, they will inform you and record this concern on the collection document. You may instruct our representative to deliver the goods in spite of such concern but we will not be liable for any damage caused to your property or to the goods as a consequence of us attempting delivery on your instructions (provided that reasonable care is taken in collecting the goods);

A delivery document must be signed by you to confirm that it has taken place. The representatives who come to deliver your goods will provide the collection document to you.

If you are not personally available to accept delivery of the goods you may appoint a representative to do so on your behalf. The representative must be an adult capable of supervising delivery on your behalf, and you agree that we will be entitled to rely on the representative’s instructions as if they were your own.

22. REFUNDING CUSTOMER(S) MONEY

We will refund the price you have paid for the goods and credit the refund due to the credit, debit or gift card that you made payment with. However, please note that we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them negligently in a way, which goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

We will also refund any delivery costs you have paid.

23. CUSTOMER(S) OBLIGATION TO PROVIDE ACCURATE INFORMATION

The customer is required to “warrant” that the information that he or she provides online when purchasing the goods, is accurate.

24. SELLER’S LIABILITY

The seller’s liability to the customer for negligence, breach of contract and statutory duty is limited to the cost of replacing the Goods ordered. It is not intended that any contract between seller and the customer for the supply of goods should be enforceable by any third party.

The seller accepts no liability for any reliance placed upon the contents of any publication supplied. The said material is intended for reference purposes only and is not intended, nor should it be used, as a substitute for professional advice and judgment or to provide legal advice with respect to particular circumstances.

25. SUPPLYING LISTS OF CUSTOMERS TO THE THIRD PARTY

Before the seller intends to supply lists of customers to a third party, he will have to seek consent of the customer(s) first.

26. REQUIREMENT OF FULL PAYMENT

Regardless modes of payment used; payment must be received in full before the goods are dispatched. This again can give protection if a credit card payment is cancelled.

27. CANCELLATION CHARGES

The seller is entitled to impose certain cancellation charges on the customer who wishes to cancel the order of the goods.

28. GOODS OWNERSHIP PRIOR TO FULL PAYMENT

The seller retains ownership until all payments have been received – this gives the seller the right to recover the goods if they were delivered before full payment has been received.

29. INTELLECTUAL PROPERTY RIGHTS

You will protect our copyright and all other intellectual property rights in the Goods, while they remain your property. You will notify any subsequent owner of such rights in the goods.

30.WARRANTIES AND LIABILITY

Under the general law there are implied warranties on the part of the seller- that the goods which he is selling will meet the description and that they will be reasonably fit for the purposes for which they are required etc. He offers a guarantee that if within a specified period any defect in the goods appears, then the seller will either repair or replace those goods, but the cost of return is at the customer’s expense.

31. NOTICES

Whenever a claim arises, it is sensible to have a formal method of giving notices. If goods are being sold online, it may be logical for e-mail notices to be accepted but the seller might prefer to have a more traditional method of notice – e.g. by fax or post.

32. FORCE MAJEURE

Certain unforeseen circumstances beyond the control of the parties might prevent the seller from making a delivery in accordance with the terms and this is covered here. The seller can cancel or suspend the contract in those circumstances.

33. DISPUTES

If there is a problem that cannot be resolved amicably, this clause allows for the possibility of mediation/arbitrator and, failing that, a dispute will be referred to the Brunei Courts. Mediation/arbitrator is a process where an independent third party endeavors in an informal meeting to resolve a dispute and it is a lot cheaper than the court processes.

34. GOVERNING LAW

Since the contract is written with Brunei Darussalam Law in mind, this I the law which governs the contract.
